Idaho fan permitted to sue stadium over lost eye

SALMON, Idaho, Feb 27 (Reuters) - An Idaho man who lost an eye after being hit by a ball during a minor league baseball game can move forward with a lawsuit against stadium owners and the team, the Idaho Supreme Court said.

Bud Rountree was attending a Boise Hawks game in August 2008 when a foul ball struck him in the eye.

Rountree in 2010 sued the stadium owners and the Boise Hawks, a Chicago Cubs farm team, for negligence in state court.

Attorneys for the defendants, known collectively as Boise Baseball, asked the court to invoke the so-called baseball rule, a legal theory that limits the duty of stadium operators to fans hit by foul balls. In an opinion handed down last week, the court said that courts do have the authority to apply the rule but that it was declining to do so.

"Whether watching baseball is inherently dangerous, and the degrees of fault to be apportioned to Rountree and Boise Baseball, are questions for the jury," justices wrote in the Feb. 22 opinion.

Boise Baseball argued that Rountree tacitly consented to expose himself to the risk of being hit by a baseball by attending a game and by possessing a ticket that said on the back: "The holder assumes all risk and dangers incidental to the game of baseball including specifically (but not exclusively) the danger of being injured by thrown or batted balls."

An Idaho judge rejected those arguments, contending it was within the purview of the state legislature - not the court - to adopt the baseball rule if it chose.

On appeal to the Idaho Supreme Court, Boise Baseball argued the court had the authority to adopt the baseball rule, as judges have done in New York and elsewhere.

Boise Baseball warned that a decision against it could open the door to lawsuits by amateur and professional athletes "voluntarily playing sports like baseball, softball, basketball . . . despite the fact that there are inherent risks to these sports" that are known and consented to by players.

California lawyer Vered Yakovee, lecturer in sports law at the University of Southern California Gould School of Law, said that when it comes to rules such as the baseball rule, very few are absolute.

New Jersey 'sea monster' is likely a lamprey

Photos of an eel-like creature captured in New Jersey have gone viral, prompting speculations of a 'sea monster.' The animal appears to be a sea lamprey, a type of parasite common in northern Atlantic waters, experts say.

Just one week after they appeared on the social news site Reddit,?photos of a strange, bloody animal caught in a New Jersey river have drawn more than one million views. The eel-like creature has a large, round mouth, thick lips, and rows of jagged teeth.

A sea monster? Probably not.?For Doug Cutler, a New Jersey fisherman who speared the creature in the Raritan River nearly two years ago, it is nothing he hasn't seen before in New Jersey waters, although that was the first time he'd actually caught one.

?A friend recently posted those pictures because we were having a contest about who had the weirdest catch. It?s nothing new to the Raritan," Cutler told the Newark Star-Ledger.

A spokeswoman of New York Department of Environmental Conservation told the paper that the animal was likely a type of sea lamprey, a parasite native to?northern Atlantic waters.

Experts say sea lampreys can grow up to 3.9 feet in length, weighing up to 5.5 pounds. Cutler said the one he caught was about 3 feet long and weighed about 4.5 pounds.

Cutler, who works at a state fish hatchery, also denied rumors that he faked the photos.?

?It shows just how disconnected people are from nature,? he told the Star-Ledger.

The sea lamprey, whose scientific name is?Petromyzon marinus, is native to the Mediterranean and North Atlantic. They can be found in the coastal seas off the Northeast USA, Nova Scotia, southern Greenland, the UK, Ireland, and Scandinavia. In the 20th century, the species spread through the Great Lakes, where they drastically reduced populations of native fish.?

Lampreys use their suckers to attach to herring, mackerel, salmon, trout, and even some sharks. They use their rough tongue to suck out fluids and tissues for food. As few as one in every seven host fish are thought to survive.?

After 2 days of big gains, stocks turn mixed

NEW YORK (AP) ? The stock market on Thursday plodded rather than soared, flicking between small ups and downs after two days of triple-digit gains.

Big-name companies reported higher quarterly earnings, and the government reported that the jobless claims are falling and that the economy did better last year than first expected. But Washington's budget battle cast a pall over the market, with spending cuts set to automatically kick in Friday and no sign that the two political parties might work out their differences beforehand.

The Dow Jones industrial average darted between small gains and losses in early trading. At mid-morning, it was down three to 14,072. That tamped down some of the buzz from the last two days about when it might top its record high. The Dow hit its highest point, 14,164.53, in October 2007, before the effects of the financial crisis had manifested themselves.

Also at midmorning, the Standard & Poor's 500 was up two at 1,518. The Nasdaq composite edged up five to 3,167.

The economic data, while enough to edge the market higher for parts of the morning, painted a picture of investors' low expectations more than one of robust growth.

The government said the U.S. economy grew at an annual rate of 0.1 percent in the last three months of 2012. That's hardly ideal, but it's better than the previous estimate. Originally, the government thought the economy had shrunk 0.1 percent in the period.

The number of Americans seeking unemployment aid also fell last week, which economists described as mildly encouraging.

"We still have work to do, still a lot of headwinds to face," said Steve Sachs, head of capital markets at ProShares in Bethesda, Md. "But long story short, we're in a better position now than we were three years ago."

The past two days have been good for the stock market. The Dow gained a combined 291 points after reports showed that Americans are more confident and are buying more homes. Investors were also relieved by Federal Reserve Chairman Ben Bernanke's avowal that the Fed will keep trying to prop up the economy with bond purchases and other programs, although that also does signify that the Fed thinks the economy is doing poorly.

In Washington, lawmakers were preparing for another fiscal cliff. Automatic government budget cuts are set to take effect Friday, slashing spending in the defense industry and elsewhere. The cuts are happening because Democrats and Republicans haven't been able to compromise over the budget, and Thursday gave no indication that they will do so any time soon. Congressional leaders weren't scheduled to meet with President Barack Obama on the matter until Friday, after the cuts have already kicked in.

The yield on the 10-year Treasury note edged down to 1.89 percent from 1.90 percent late Wednesday.

Among companies making big moves:

?Groupon, the coupons website, plunged 21 percent after reporting late Wednesday that its quarterly loss had expanded. The stock fell $1.26 to $4.72.

?J.C. Penney fell 19 percent. Investors were unnerved by the quarterly loss the department store reported late Wednesday, which was larger than they were expecting. The stock dropped $4.10 to $17.06.

?A number of retailers and restaurants reported results Thursday morning. Wendy's, Domino's and the clothing chain Chico's were all up after reporting higher profit and revenue.

Investigator: BP Wasn't Prepared For Disasters At Deepwater Oil Wells

Tuesday marked the second day of a civil trial connected to the 2010 Deepwater Horizon explosion and oil spill in New Orleans. With opening statements over, plaintiffs began calling witnesses. Melissa Block talks to Jeff Brady.

There was harsh criticism of BP from the witness stand today and tough cross-examination in the lawsuit over the Deepwater Horizon oil spill. An explosion at that oil rig killed 11 people back in 2010 and led to a massive spill. The civil trial is in its second day in U.S. district court in New Orleans. Witnesses for the plaintiffs began their testimony.

And NPR's Jeff Brady was in the courtroom. And, Jeff, who was testifying today? Who took the witness stand today?

JEFF BRADY, BYLINE: The first witness was Bob Bea. He's an engineering professor at the University of California, Berkeley. He testified for the plaintiffs. His expertise is something called process safety. Essentially, that's the things a company can do to limit catastrophic accidents like the Deepwater Horizon explosion.

Bea testified that BP didn't have the risk management systems in place that are necessary for the dangerous work of drilling deepwater oil wells. And he knows this because he was consulting with BP on the subject. Bea said he repeatedly warned the company starting in 2003.

He said BP was talking about his recommendations, but not implementing them and by 2007, Bea's warnings were becoming more aggressive. In one note, he said, "you still don't get it. Process safety is deadly serious and you've turned it into a traveling road show."

BLOCK: A traveling road show, were his words. Really strong criticism there of BP. And as we mentioned, there was some rigorous cross-examination that followed, right?

BRADY: Right. BP's attorney, Mike Brock, cross-examined Professor Bea and he pointed out that implementing these process safety programs takes a long time and it's expensive. The lawyer went through a series of indications that BP was developing the kinds of safety systems that Bea advocates for. And as you might imagine, there were plenty of times, while Bea was working for BP, that he gave the company credit for the progress it was making.

And attorney Brock made sure the judge was aware of those times and then he detailed some of the progress BP had made and communications from executives saying that safety was very important to them. At one point, attorney Brock said to Professor Bea, quote, "this doesn't present evidence of a company that is cutting safety corners, does it?"

And Professor Bea answered no.

BLOCK: And later today, Jeff, I understand that a BP executive also took the witness stand. What did he have to say? for much of the day. How many more witnesses are there?

BRADY: Yeah. His name is Lamar McKay and he was the head of BP America when the Deepwater Horizon accident happened in 2010. He was recently promoted, though. Now he's the head of all of BP's exploration and production business. At the trial, one of the plaintiff's lawyers, Robert Cunningham, tried very hard to box McKay into a corner and get him to say that BP was primarily responsible for everything that led to the blow-out at its Macondo well. But Mr. McKay stuck to what has been BP's line all along that this disaster was the result of many mistakes that were made by everyone involved. That includes BP but also its contractors.

BLOCK: And, Jeff, we've talked about two witnesses on this first day of testimony. How many more witnesses are there to come?

BRADY: Oh, there are dozens, at least 53 witnesses. In fact, Judge Carl Barbier said at the end of the proceedings today that he sat down to figure out how long this trial could last at the current pace. He didn't say exactly how long that was but he determined it will have to move along more quickly than this. Judge Barbier says he is committed to wrapping up this trial by the end of May. This is such a complicated case, though. On one side you have the plaintiffs, including the federal government and the five states on the Gulf coast. Their message is pretty uniform, that BP was grossly negligent leading up to this well blowout and oil spill and the company should receive the stiffest penalties.

Then on the other side, you have all the defendants, BP and its contractors, like Transocean and Halliburton, but they're much less unified. While they're countering the claims from the plaintiffs, they're also pointing fingers of blame at each other. So it's not just a one side against the other type of case.

Turkey seeks to relocate European foster children to Muslim families ...

Turkey has embarked on a campaign to retrieve children of Turkish immigrant families living in Europe who are fostered by foreigners, and instead place them in homes where their cultural identity can be preserved.

The step comes after a court in the Netherlands refused last week to return nine-year-old Yunus ? who had been taken into care by a Dutch lesbian couple ? to his biological Turkish family, reportedly citing the mother?s inability to speak Dutch.

Turkey fears that children placed in Christian homes will forget their Muslim roots, and also disapproves of placements with gay couples.

A statement from Turkey?s expatriates authority YTB said that Yunus?s foster parents frequently took him to church, and that ?out of his confusion about the family institution?, he calls both foster parents ?mother?.

Following the verdict, Turkey?s Deputy Prime Minister Bekir Bozdag told reporters: ?Turkish families just do not want to give their kids to gay or lesbian couples.

?It is important for kids to be raised in an environment similar to (their) home culture.?

Turkey had since stepped up efforts to guide the family through legal procedures to get Yunus back. Failing that, Bozdag said, authorities would push to get the boy placed with parents the family would approve of.

Unlike some European countries, same-sex marriages are not recognised in Muslim-majority Turkey where homosexuality remains taboo.

Former Families Minister Aliye Kavaf found herself at the centre of a public row in 2010 after she described homosexuality as a ?disease that needs to be treated?.

The campaign specifically concerns the children of Turkish families living in countries like Germany or the Netherlands, both home to large Turkish expatriate populations.

Germany is home to at least three million Turks, who make up the country?s largest minority, while around half a million Turks have set up home in the Netherlands.

Turkey?s parliamentary Human Rights Commission estimates that at least 5,000 Turkish children in Germany have been placed in foster care.

While the commission has not submitted any formal request to retrieve Turkish children, international conventions do give Turkey the right to do so, ruling party lawmaker Ayhan Sefer Ustun, who heads the commission, told AFP.

?We might exercise that right if protective measures continue to pose this problem,? he warned.

Foreign ministry spokesperson Levent Gumrukcu confirmed that Ankara was keeping a ?watchful eye? on fostering abroad.

European fostering bodies take children into their care for different reasons: the death of the parents, poverty or parental negligence.

They say their priority is to place the children under the protection of the best possible caregiver.

?We try really hard to find the best possible match for the child in a foster home,? Hilje Wolfson, spokesperson for a Dutch foster foundation, told AFP.

?That?s why we always first look into the network: are there family members who can take care of a child?? she said. They did make efforts to keep Turkish children in their original environment so they could keep their ties with their culture, she added.

Part of the problem is that very few children are fostered by other Turkish families, usually only by European families.

?Throughout these 50 years we lived in Europe, we have established mosques, tea shops, restaurants? But apparently we never thought of our posterity,? said Kamil Altay, head of the Germany-based Umut Yildizi (Star of Hope), established to encourage Turkish expatriates to foster.

?There were virtually no Turkish foster families before this campaign ? kids naturally end up with European families and forget their languages and culture,? he added.

?After years of foster care, they sometimes do not even know they are Turkish.?

In the case that a child needs fostering, the NGO helps families submit to court a list of potential legal guardians they know and trust, the head of Umut Yildizi?s Dutch branch Kasim Akdemir told AFP.

?Families do not even know their rights? If more Turks step in, this will help relieve the Dutch authorities too,? Akdemir added.

?I think (children) are way happier if they are placed in Turkish families, who speak their language, cook meals the way their mother does,? said Nejla Buran, a 47-year-old Turkish activist. In 2007, she became a foster mother to two brothers, then aged two-and-a-half and eight.

Buran, who also has three children of her own, said she believes the boys would have suffered a ?second trauma? if they had been placed in a German home, with parents who did not speak their language.

?The welfare agency instructed the boys to address me as Frau (Mrs) Buran but they switched to ?auntie? right away,? she said.

And, she added: ?Our doors are also open to the biological family any time of the day.?

Shell halts Arctic drilling for 2013

Royal Dutch Shell has said that it will suspend its offshore drilling programme in the Arctic for the rest of 2013 in order to give time to ensure safety.

The decision to pause drilling for oil in the Chukchi and Beaufort Seas off Alaska was widely expected, following a catalogue of problems last year.

The US Department of Justice is looking into safety failures at one rig.

The move "will give us time to ensure the readiness of all our equipment and people", said Marvin Odum of Shell Oil.

"We've made progress in Alaska, but this is a long-term programme that we are pursuing in a safe and measured way," he added.

'Good decision'

Shell first obtained licences from the US Department of the Interior in 2005 to explore the Arctic ocean off the northern and north-western coasts of Alaska.

It has since spent $4.5bn (?3bn), culminating in two exploratory wells completed during the short summer drilling season last year.

But Shell ran into multiple problems during the drilling programme:

  • the company failed to have a spill-response barge on site before the drills reached oil-bearing zones, as it had promised, and a containment dome was damaged during testing
  • drilling in the Chukchi Sea had to be called off less than 24 hours after it began on 9 September due to a major ice floe
  • a fire broke out on the Noble Discoverer rig that Shell had hired for the Chukchi Sea drilling, and the US Coast Guard discovered 16 safety violations on board, which have now been passed to the justice department
  • the Kulluk, a circular drilling barge, broke away from its towing vessel and ran aground on its way to a shipyard in Washington State in late December

The decision to abort drilling this year may in part be due to the fact that both drilling rigs are likely to be stuck in East Asia, undergoing repairs.

Shell has also faced widespread opposition to its activities from environmental activists.

"This is the first good decision we've seen from Shell," said Mike le Vine of Oceana, a group which focuses on ocean conservation.

"Given the disastrous 2012 season, our government agencies must take advantage of this opportunity to reassess the way decisions are made about our ocean resources and to reconsider the commitment to explore for oil in the Arctic Ocean."

US Interior Secretary Ken Salazar has said his department will carry out a high-level assessment of what when wrong with Shell's operations last year.

Watch a Solar Plane Disappear in One Minute

Now that the Solar Impulse has set endurance records for solar-powered flight, including staying aloft for more than 24 consecutive hours, the plane is coming to America. As we reported in December, the Swiss project's backers are bringing Solar Impulse to California this year. Beginning in the spring, they will fly across America in multiple legs, concluding the trek in New York. But first they have to get their plane to the States.

Solar Impulse just released this time-lapse video of the aircraft's deconstruction. It took engineers a full week to disassemble the sun-powered plane and box it up for its transatlantic journey from Switzerland to the Golden State. In the time-lapse video above, it all happens in just 59 seconds.

While it'll be exciting to see the experimental aircraft on its American tour, the main attraction comes in 2015, when, pilots Andr? Borschberg and Bertrand Piccard say, they will fly a larger version of Solar Impulse around the globe.

NewsMaker - NBN rolls out; Small Business shrugs

Four in ten small business owners say the National Broadband Network (NBN) will not help their business according to the latest State of the Nation Report (No. 14), launched today by Michele Levine, CEO of Roy Morgan Research.

Around three in ten owners do expect a benefit, with the rest still unsure about what the business benefits will be of the Federal Government?s $37.4 billion infrastructure project.

NBN attitudes may connect to general small business opinion of the Federal Government. Small businesses in NSW and Queensland are the harshest critics of the Federal Government?s performance at fostering a climate of business growth: 61% of small businesses in these States rate the government?s performance as ?very poor?. These States also report the most scepticism of the NBN, with 43% not expecting any benefit.

Victorian and Tasmanian small businesses are the most likely to expect to benefit from the NBN (33%), with South and Western Australians least likely (24%).

Capital city small businesses are more positive about the future impact of the NBN than those in regional areas. Agriculture, Mining and Transport industry businesses are the least likely to expect a benefit to high-speed internet. However while almost half of small Mining businesses can?t see a benefit, 34% can?the highest positive reaction behind Professional Services, of whom 36% see some benefit.

As of December, 339,700 home, business or public premises have access to either fibre-to-the-premises, fixed wireless or satellite broadband.

However only 72,400 of these are the fibre connections which will ultimately reach 93% of Australian premises.

NBN Co expects fibre to be available to almost another 270,000 premises by mid-2013. The rollout plans to reach over another 3 million premises in the next two years, with completion by 2021 and recovery of costs by 2033.

Pope recalls 'joy' of papacy, and difficulties

VATICAN CITY (AP) ? Pope Benedict XVI basked in an emotional sendoff Wednesday from a massive crowd at his final general audience in St. Peter's Square, recalling moments of "joy and light" during his papacy but also times of difficulty when "it seemed like the Lord was sleeping."

An estimated 150,000 people, many toting banners saying "Grazie!" ("Thank you!"), jammed the piazza to bid Benedict farewell and hear his final speech as pontiff. In this appointment ? which he has kept each week for eight years to teach the world about the Catholic faith ? Benedict gave deep thanks to his flock for respecting his decision to retire.

Benedict clearly enjoyed the crowds, taking a long victory lap around the square in an open-sided car and stopping to kiss and bless half a dozen children handed to him by his secretary. A total of 70 cardinals, some tearful, sat in solemn attendance.

But Benedict made a quick exit, foregoing the typical meet-and-greet session that follows the audience; the Vatican has said there were simply too many people who would have wanted to say goodbye.

Given the historic moment, Benedict also changed course and didn't produce his typical professorial Wednesday catechism lesson. Rather, he made his final public appearance in St. Peter's a personal one, explaining once again why he was becoming the first pope in 600 years to resign and urging the faithful to pray for his successor.

"To love the church means also to have the courage to take difficult, painful decisions, always keeping the good of the church in mind, not oneself," Benedict said to thundering applause.

He noted that a pope has no privacy: "He belongs always and forever to everyone, to the whole church." But the pope promised that in retirement he would not be returning to private life ? instead taking on a new experience of service to the church through prayer.

He recalled that when he was elected pope on April 19, 2005, he questioned if God truly wanted it. "It's a great burden that you've placed on my shoulders," he recalled telling God.

During his eight years as pope, Benedict said, "I have had moments of joy and light, but also moments that haven't been easy ... moments of turbulent seas and rough winds, as has occurred in the history of the church when it seemed like the Lord was sleeping."

But he said he never felt alone, that God always guided him, and he thanked his cardinals and colleagues for their support and for "understanding and respecting this important decision."

Under a bright sun and blue skies, the square was overflowing with pilgrims and curiosity-seekers. Those who couldn't get in picked spots along the main boulevard leading to the square to watch the event on giant TV screens. Some 50,000 tickets were requested for Benedict's final master class. In the end, the Vatican estimated that 150,000 people flocked to the farewell.

"It's difficult ? the emotion is so big," said Jan Marie, a 53-year-old Roman in his first years as a seminarian. "We came to support the pope's decision."

With chants of "Benedetto!" erupting often, the mood was far more buoyant than during the pope's final Sunday blessing. It recalled the jubilant turnouts that often accompanied him at World Youth Days and events involving his predecessor, Pope John Paul II.

Benedict has said he decided to retire after realizing that, at 85, he simply didn't have the "strength of mind or body" to carry on.

"I have taken this step with the full understanding of the seriousness and also novelty of the decision, but with a profound serenity in my soul," Benedict told the crowd Wednesday.

Benedict will meet Thursday morning with cardinals for a final time, then fly by helicopter to the papal residence at Castel Gandolfo south of Rome.

There, at 8 p.m., the doors of the palazzo will close and the Swiss Guards in attendance will go off duty, their service protecting the head of the Catholic Church over ? for now.

Many of the cardinals who will choose Benedict's successor were in St. Peter's Square for his final audience. Those included retired Los Angeles Cardinal Roger Mahony, the object of a grass-roots campaign in the U.S. to persuade him to recuse himself for having covered up for sexually abusive priests. Mahony has said he will be among the 115 cardinals voting on who the next pope should be.

Also in attendance Wednesday were cardinals over 80, who can't participate in the conclave but will participate in meetings next week to discuss the problems facing the church and the qualities needed in a new pope.

"I am joining the entire church in praying that the cardinal electors will have the help of the Holy Spirit," said Spanish Cardinal Julian Herranz, 82.

Herranz has been authorized by the pope to brief voting-age cardinals on his investigation into the leaks of papal documents that exposed corruption in the Vatican administration.

Vatican officials say cardinals will begin meeting Monday to decide when to set the date for the conclave.

But the rank-and-file faithful in the crowd Wednesday weren't so concerned with the future; they wanted to savor the final moments with the pope they have known for years.

"I came to thank him for the testimony that he has given the church," said Maria Cristina Chiarini, a 52-year-old homemaker who traveled by train from Lugo in central Italy with some 60 members of her parish. "There's nostalgia, human nostalgia, but also comfort, because as a Christian we have hope. The Lord won't leave us without a guide."

Promising treatment for years-long hives
People with hives that recur for years and even decades might get relief from an allergy drug. Called omalizumab and marketed as Xolair, the drug inhibits the rogue antibody immunoglobulin E, which brings on persistent, intense itching and body-covering hives in some people. Scientists randomly assigned 323 patients with chronic hives, also called urticaria, to get three shots of the medicine spaced four weeks apart. One-quarter of them got a placebo while the others received one of three doses of the drug. Patients getting the two highest doses experienced substantial declines in itching that lasted until four weeks after the last shot, and 40 percent of the highest-dose group saw their hives disappear completely during treatment, said study coauthor Thomas Casale, an allergist at Creighton University in Omaha, Neb. Twelve weeks after the last shot, symptoms had started to return in most patients. Even so, said allergist and coauthor Allen Kaplan of the Medical University of South Carolina in Charleston, omalizumab could offer respite for patients with chronic hives. Roughly half fail to benefit from antihistamines at some point, as did everyone in this trial. ?Many of us in the field view [omalizumab] as a game changer for these patients,? Kaplan said. The researchers reported the finding February 24 at the meeting and in the New England Journal of Medicine. ?

Allergic kids? growth at risk
Children with an allergy to dairy products weigh less on average than kids who can eat what they want, researchers at the University of North Carolina at Chapel Hill reported February 24. The scientists analyzed medical records of 245 food-allergic children up to age 11 and took note of any food allergies diagnosed from 2007 to 2011. Several allergies showed up? to peanuts, eggs, dairy and other foods. Overall, the children with more than two food allergies were slightly shorter than other children without food allergies. But only allergy to milk was undoubtedly linked to lower body weight, and this association was most striking in children who were younger than two years old, said study coauthor Caroline Hobbs, a pediatrician. Such children should receive special care, she said. ?By that I mean dietary intervention ? referral to a nutritionist or dietary counselor of some sort ? to create diet alternatives.?

Vitamin D may boost hepatitis B shot
Compared to men with low levels of vitamin D, men with high levels might get more out of a hepatitis B vaccination, South Korean researchers reported. Scientists obtained blood samples from 5,025 men after they got immunized against hepatitis B. When the researchers divided the men into groups with low, medium or high levels of vitamin D, they found those in the low group had made much less protective antibody against hepatitis than did those in the high vitamin D group, Ju-Suk Lee of Sungkyunkwan University in Changwon reported on February 23. The findings jibe with other evidence that vitamin D helps regulate immune function. Men who smoked, were older, had diabetes or were heavier also had a muted response to the vaccine. Taken together, the analysis suggests that those factors might have a stronger negative effect on vaccination benefit than low vitamin D levels do.

Baby Eight... memories and thoughts about our growing family

A New Baby is Coming!
As Everett moved from babyhood to toddler-hood we felt more and more like babies were really and truly ending for us. We felt this way with Sebastian too though...But...? -and there is always a "but" when you use natural family planning- we welcome this new baby into our hearts and home and we feel blessed and thankful for him or her. Having many, many, many children to us is just a part of our life and we embrace each baby as a gift and blessing.

The kids are completely excited and we are ready for another newborn. (We just don't think about the money, new car seats, bigger cars, teething, toddler hood meltdowns, temper tantrums, homeschooling, braces, and sleepless nights! ; ) We live in a bubble of bliss? New baby? No problem. We?ll fit the kiddo in somewhere. This is the basic attitude of big families. A lot can be solved with more bunk beds, faith, and love. Many don?t understand it, but those with big families I know seem too.?

Finding Out?
?I was afraid I'd have the morning sickness and fatigue I had with Everett.? I didn't end up that miserable thank goodness, but I was extremely whiny about the morning sickness for a little while because I just flat out gave into it. At that time I also had homeschool and toddler burn out and I just didn't feel like dealing with the added unhappiness of morning sickness. Ricky's positive and loving attitude helped so much. I didn't want to tell anyone about the baby right away because I didn't want to seem unexcited just because I didn't feel good. The news started coming out the week of Christmas but there's a lot of people that still don't know.

One night I was exhausted and ready to fall asleep. I crawled into bed and let myself sink into comfortableness. I tried to let the calm wash over me. Then I blurted out loudly, "How can this happen!? How does this happen to us??" Ricky smiled at me and scooped me up with both of his arms like a baby and said, "Well, when a mommy and daddy love each other very, very much..." I laughed at his sweetness and sense of?humor. The look in his eyes was so seriously loving and wise. He effortlessly accepts our life together and the craziness it brings. I absolutely love being married to him. I love how much he loves babies. With his hand to my belly he told me that I need to hurry up and 'get fatter' so he has a baby-belly to rub. If I am nervous or have doubts -I just about ALWAYS do the first three months- about having another baby or what the future could bring he always knows what to say. I want to always remember the sincerity and love in his eyes for me and our babies/kids. He has so much faith and trust. It always helps me get through the hectic morning sickness days. The look in his eyes gives me the warmest feeling. Our life will get richer with laughter and happiness even if we get poorer in our finances and deafer from children yelling, running, playing and climbing up the walls. Whatever love and happiness and hardship and stress we will have in the months and years to come we will continue do what we've always done. I always feel like we don't know what we are getting ourselves into, but it's always okay.?

June!
We are glad to have broken the fall baby streak! We have a lot of birthdays in the fall months:? two August children, two in September and one in October. The youngest kids ask constantly about this spring/summer and the baby. Everyone in the house seems to be talking about this June. Even at the dentist's office yesterday Sebastian asks me, "Mom how long until June again?" This baby has already stolen our hearts and brought meaning and joy to all of our lives. I feel like having a party when the baby is born, the kids can make and hang decorations, balloons, party poppers and a cake. I'll let them wrap some clothes, cloth diapers and baby blankets up. It will keep them busy. I think I'll have a tub of supplies ready for them for them and they can do it the day -or the week- the baby is born. Something fun they can do and plan all on their own.

Family is the essence that helps define our identity

Over the past five months I have reflected on and realized what a huge family we have created and how layers upon layers of family have started because of us. We get caught up with life, work, money and chores but don't always stop to think about what we have created as the result of our calling to have a giant family. I got to thinking about siblings, cousins, aunts, uncles, grandparents...I got to thinking about when I was growing up and how I thought I had a big family (my parents are each one of four children and my dad remarried and had 5 children total (I'm the oldest of the five). Growing up I did have a big family, the biggest of anyone I knew. We had: big holidays, big picnics, big family turnouts at school plays, big weddings, big Easter egg hunts, packed BBQ's. I grew up with a nice large group of brothers and sisters, someone to always love, annoy, and play with. I grew up with a handful of cousins, too. My entire extended family even likes to vacation together.

This realization did make me really sad though because I live 1500 miles away from most of these people, including every one of my siblings and parents. I wish we were shuffling our eight kids to family gatherings taking up lots of space and sharing good times, hard times, and love with everyone.? My sadness was filled with joy too though because even though I'm far away and wish I had my large family near us, our kids still have each other. They are growing up with a large family foundation, siblings and playmates. We do have family here too (his and mine) and that is special and wonderful in many ways but we still live a couple or few hours away from them and miss seeing them. When I think about all this I can't help but to imagine what our family will bloom into when our kids have kids, and their kids have kids. We have created a potentially monster size family that will grow into generations of love, morals and togetherness --if we did our job correctly.

The way we followed our hearts and beliefs as we were lead to have eight children is still somewhat surreal to us since we live in a society that thinks it's weird. However the enormous amount of congrats and support we receive is amazing, and from what I hear from other large families pretty unheard of. The majority of people we know care about us, believe in us, and respect us. It's truly a blessing and it means SO, so much to me. I hear from or read about other big families and so many of them have terrible stories to tell about strangers being disapproving, or even their own family members saying rude things to them about having a large family! I feel elated and blessed that I can say we have never had to go through that. Even so, each time we announce another pregnancy we do so semi-nervously. We feel happy and in love and excited in our home...and then sometimes we feel awkward and nervous about what other people think. Of course we shrug it off, of course it only ultimately matters how WE feel. If we are doing a great job and if our kids are happy and are raised in an awesome loving home... that is truly what matters. It's still sometimes weird to be the "weird ones" that have never heard of birth control or the ones that don?t know what "causes that." :)? So I wanted to write and remember how much I appreciate the support and congrats we ALWAYS get. This is our baby; it doesn't matter if a pregnancy is the first or the third to a couple -or the 15th- Our baby is OURS and we love him or her and that baby is already a part of everything we do and love.

A friend just sent me her copy of the newest Duggar book to read and it's the perfect timing! I'm very thankful! It's inspiring for me to read and enjoy the Duggar family after going through a lot of stress and being really cranky with the kids lately. I had just talked to Ricky about how over the past few months I started a really bad habit of taking my stress out on the older kids, grumbling at them, and being over critical of how they do things. I expressed to him the fears I had that they would grow up and be that way if I did not change. I have changed this habit and told them I was wrong to act that way and I'm sorry. Reading about the Duggars makes me feel more grounded, inspired, motivated, and more thoughtful in general. I focus on and aspire to raise a family full of love, compassion and respect for each other as they do.

This is what I mean new little baby- you are already a person that we love. Welcome little baby, we?re so glad you?ve come to us!
