Stocks continue lower entering midafternoon

Stocks stayed lower entering midafternoon Monday, despite the fact that October was shaping up to be one of the best months for the market ever.

Just after 12:30 Eastern the Dow Jones industrial average was down 1.5 percent. The S&P 500 was off 1.6 percent. The Nasdaq was down 1.4 percent.

A major drag on the market was brokerage MF Global filing for bankruptcy.

The Standard & Poor's 500 index has gained 12 percent for the month, which puts the broadest stock-market measure on track for its best month since January 1987. Even after a decline in midday trading Monday, the Dow Jones industrial average is still up 10.7 percent in October, its best month since August 1982. ?

The Organization for Economic Cooperation and Development warned Monday that European economies will see a "marked slowdown" next year. The organization called on the European Union to provide more information on how it plans to stem the debt crisis.

The European debt crisis is still far from fixed. One troubling sign is that borrowing costs for Italy and Spain have increased, a signal that traders remain worried about their ability to pay their debts.

Irresponsible Romney: 'We Don't Know What's Causing Climate Change' (ContributorNetwork)

COMMENTARY | The problem with politicians is that for far too many of them, science is subject to convenience. Take for example the words of former Massachusetts governor and the most likely GOP nominee for the 2012 presidential election.

According to the Huffington Post, Mitt Romney told a group of supporters at the Consol Energy Center in Pittsburgh: "My view is that we don't know what's causing climate change on this planet. And the idea of spending trillions and trillions of dollars to try to reduce CO2 emissions is not the right course for us. My view with regards to energy policy is pretty straightforward: I want us to become energy secure and independent of the oil cartels."

Sometimes when I read a quote from a politician, I literally spit expletives at my computer screen. The fact is we do know what's causing climate change. To say otherwise is a blatant lie, aimed at a constituency that thinks absolutes can be fudged.

I will give you that Al Gore's plea to save the snows of Kilimanjaro is a bit weak. I've never been to Kilimanjaro, and if I ever go, I doubt the snow will be my favorite part of the experience. Gore appealed to outdoorsy people, but my idea of roughing it is a hotel where room service shuts down at 8 p.m. So for the climate change skeptics who say that Kilimanjaro's snow and the plight of polar bears is no big deal, let me just say this: Earth is the only planet we know how to live on.

If the scientists are wrong, we're out a few trillion dollars, but friends, if they're right, that's the ballgame. Oh, Earth will be fine. George Carlin was right. Earth will shake off our existence like a minor head cold. But I'm sort of fond of humanity. Climate change is happening now. It's threatening our existence now. Scientists aren't political, but politicians aren't immune from science. Neither are the rest of us. Mitt Romney is irresponsible. He should apologize and drop out. We deserve better.

Social and mobile game developer 6waves Lolapps has acquired Beijing-based social gaming company Smartron5. Financial terms of the deal were not disclosed.

Smartron5, which is backed by Origo Partners, has been developing social games with deeper game play experiences for Asian and international social networks. Smartron5?s CEO, Gage Galinger will become 6waves Lolapps? Vice President of Content Development and will head up operations for the company in China.

Galinger previously held gaming positions at Electronic Arts, Enorbus, Microsoft and Blizzard. The Smartron5 team will focused on product development for the local social and mobile market. Around fifty percent of Smartron5?s focus will be on mobile development

The acquisition expands 6waves Lolapps? presence in the Asian market, adding to its existing Hong Kong and Tokyo offices. The gaming company now has more than 75 employees in Asia, with more than 170 employees worldwide.

As Lolapps CEO Arjun Sethi explained, ?Having a presence in China is important to us, especially in developing high-quality, localized games.?

?The Asian market is complex and the Smartron5 team brings western-production values with a deep understanding of how to be successful in China,? said Rex NG, CEO of 6waves Lolapps. ?This addition to our team is key to our globalization strategy and will benefit our own game development efforts as well as those of our publishing partners.?

Lolapps and 6Waves merged earlier this year to create a larger network of social gaming applications on Facebook and the web. Libyans want back property taken by Gadhafi

Abdullah Ahmed Belal had all but given up on the sprawling seaside villa his family lost to squatters decades ago because of a provision in Moammar Gadhafi's Green Book saying anybody who lives in the house should own it.

Belal, a 48-year-old naval officer, is one of many Libyans who want their properties back now that the hated dictator is gone.

Mustafa Abdul-Jalil, head of the governing National Transitional Council, has called for such disputes to be settled legally. Belal is willing to be patient, but others have taken matters into their own hands ? a sign of the post-revolutionary fights that threaten to rattle Libya as it transitions from decades of autocratic rule to what its interim leaders say will be democracy.

Armed men have tried to force families out at gunpoint, and neighbors have been caught in the crossfire as they tried to intervene. Even original owners willing to wait have spray painted their names on the concrete walls surrounding the buildings.

"The NTC keeps asking people to postpone trying to get their rights back until a committee is formed and it can be done legally," said Abdullah Belal, a Tripoli contract lawyer and a nephew of Abdullah Ahmed Belal. "They say you've waited 42 years, you can wait another month or two, but some people don't want to wait."

He described one instance in which the original owners came back with machine guns to force a Palestinian family from their home in Souk al-Jumaa, giving them no time to pack more than the belongings they could gather that night.

"We desperately need to get our properties and rights back, but at the same time we don't want anybody to be hurt because in the end the only one to blame is Moammar Gadhafi," the lawyer said.

Quirky manifesto
The question of legality is murky in a country that was governed by the whims of one man for nearly 42 years.

The Green Book, the slain leader's quirky political manifesto that dictated the lives of Libyans, allowed people to occupy empty houses that had been purchased as rentals or vacated by landlords traveling abroad. High rises and other commercial buildings also were taken, often with no compensation.

It may be hard now to prove original ownership because the building holding property records burned down in 1982 under mysterious circumstances, and those who initially confiscated the property often resold it with new documents.

In some cases, gunmen laying claim to homes were not in fact the original owners.

In 1977, a colonel in Gadhafi's army is said to have seized a house on a side street in Tripoli's affluent Hay al-Andalous neighborhood.

On Sept. 8, nearly 35 years later, a man armed with a machine gun showed up around midnight to reclaim what he said was his.

Witnesses told The Associated Press that neighbors rushed to the scene and tried to calm him down, saying he should wait until the issue could be resolved in a court of law, but the man was drunk and refused to listen. His friend got out of the car and they both opened fire.

One of the neighbors, Tarek Abu Aisha, 38, was shot and killed, and two others were wounded. Bullet holes still pockmark the pavement as well as the iron door of a four-story apartment building across the street.

Seif Saad al-Jarushi, 36-year-old school bus driver who lives down the street, said the gunmen fled as revolutionary forces arrived.

He said the man currently occupying the house took his family away and only comes home at night.

He and other neighbors said they learned that the colonel who seized the house in the late 1970s had sold it to three different people after the uprising against Gadhafi took root in mid-February. The armed man who came to claim it was one of them.

Al-Jarushi said neighbors are ready to fight if the man comes back to try again.

"Even if he has the right, he should not be trying to get his rights this way. He should do it through legal means," he said, swatting away flies during an interview on a corner near the house.

Verifying ownership
The nationalization of businesses and property was one of the most glaring examples of Gadhafi's efforts to force his version of socialism on the desert nation of 6 million people. With the introduction of the property law in the late 1970s, thousands of landlords lost homes when tenants claimed them as their own. People also were allowed to occupy empty buildings.

Apparently sensing public anger over the issue, the regime late last year offered compensation to Libyans who could prove that they had owned confiscated property ? part of purported reforms initiated by Gadhafi's son Seif al-Islam.

"This decision should have been taken many years ago," said Mustafa Bushaal, a member of the newly established Libyan Association for Justice and Development, which is discussing various ways to resolve the housing problem. He said the process was fraught with corruption.

Some solutions being floated include giving newly evicted families apartments being built by the government on Tripoli's outskirts or offering them compensation so they can find a new place to live.

Bushaal said the Tripoli city government already has asked claimants to present documentation for their property.

"The first thing is to convince the family that it's not their house, then find alternative housing for the other family," he said.

It is impossible to know just how many homes were confiscated by the Gadhafi regime, which destroyed many of the original documents.

Belal, the naval officer, said his father bought the seaside home in 1975 and eventually gave it to him.

Belal said he allowed a foreign company to rent it when he went abroad to study. When he returned to Libya in 1984 to start a family, he found that squatters had moved in after the company left.

He said the police told him the Green Book had given the family the right to move into the house.

Belal, who currently rents an apartment with his family, says he does not want to kick the family out of his original home until they have somewhere else to go. But he said a legal solution must come very soon.

"There are so many people with similar problems," he said. "The government should move very fast to solve this problem or there will be another civil war."

Les Ferdinand: Ban Terry if claims are proven

LONDON (AP) -Former England striker Les Ferdinand, whose cousin is at the center of the racism investigation against John Terry, does not want the England captain to be allowed to play for his country again if he is found guilty.

The Football Association is investigating whether the Chelsea captain directed a racial slur at Queens Park Rangers defender Anton Ferdinand during a Premier League match on Sunday.

The probe was triggered Tuesday by QPR's official complaint after footage of Terry apparently mouthing the insult at the black player spread on social networking sites.

Terry has denied allegations of racism, saying his comments were taken out of context.

But if Terry was found guilty, his future playing for England - not only as captain - would be thrown into doubt, just seven months after regaining the armband following a sex scandal.

Anton Ferdinand's close relative said the English football authorities need to be seen to be acting tough on racism.

Asked if Terry should be banned from the national team if the allegations were proven, Les Ferdinand said Wednesday: "It's down to the FA, but I'd be shouting from the rooftops (for that)."

"They need to make a statement," he added. "If they don't make a statement, paltry fines that have been handed out in the past prove to people that these people do not believe there is a problem with racism in football."

Ferdinand spoke to The Associated Press at the Black List Awards in London, which recognize the achievements of black people in English football. He said he has to speak to his cousin about the incident.

"The more we see (racism) is a problem and we can do something about it, the more it eradicates the problem from happening," Ferdinand said. "Until we can do that, this problem will continue (to) happen and I think it will steadily get worse until major steps are taken about stamping this out."

The Terry incident is also being investigated by police in London.

The 30-year-old defender said the alleged comments directed at Ferdinand were taken out of context by social media users who spread the video on Sunday night.

"I thought Anton was accusing me of using a racist slur against him," he said after the match. "I responded aggressively, saying that I never used that term."

The incident happened during English football's anti-racism week, which highlights the progress made since abuse marred the game in the 1970s and 80s.

And it came just a week after the FA launched a probe into allegations that Liverpool striker Luis Suarez racially abused Manchester United's black defender Patrice Evra during a Premier League match.

"I think the FA, FIFA and UEFA have been in positions where they have been able to stamp out a few problems which have reared their ugly heads in the last few years and they haven't done so, or they haven't done it diligently enough," Ferdinand said. "And I think that's what has brought us to where we are today talking about this situation (with Anton)."

Aye matey, pirates plundered 'Modern Warfare 3'

Pirates have reportedly made off with a partial copy of the highly anticipated game "Modern Warfare 3." If you happen to have a copy, Activision would like you to delete it ... pretty please.

Listen up ye scurvy dogs, if you're already playing the year's most anticipated game, then you might want to stop.

We're talking "Call of?Duty: Modern Warfare 3" here, which hasn't actually launched yet but apparently has been stolen and pirated.

VentureBeat reports that pirates have managed to get their hands on at least a partial copy of the PC version of the game?? which doesn't officially launch until Nov. 8.


According to their report, an employee at a shipping warehouse in Fresno stole a single disc, which then?? thanks to the powers of the Internets ? began spreading far and wide via torrent sites. That employee, however, only stole Disc 2 of a two-disc PC set.

Venture beat also reports that Activision is actively hunting down pirated copies of their highly anticipated game and is asking players to delete the illegal copies or potentially face fines.

Meanwhile, game site Kotaku posted a YouTube video that allegedly showed a PS3 copy of the game being played.

The video has since been pulled with only this message remaining: "This video is no longer available due to a copyright claim by Activision Games Inc."

This is hardly the first time this sort of thing has happened. In fact, the previous "Call of Duty: Black Ops" was pirated in advance of launch and was eventually named the most pirated game of 2010. Earlier this year, both "Crysis 2," "Killzone 3" and "Gears of War 3" were leaked ahead of their release dates.

"Modern Warfare 3," however, is perhaps the biggest of the big game launches this year. But seriously people, you only have to wait 11 more days to wait before you get a legit and complete copy of?the game?... and then you won't have to fret about Activision's men in black knocking on your front door as you play it.

Until then, you could always kill some time by, oh, I dunno, playing "Battlefield 3" or something.

Red Bulls hold off FC Dallas to advance

FRISCO, Texas - Joel Lindpere scored in the 61st minute and the New York Red Bulls withstood a late charge to hold off FC Dallas 2-0 on Wednesday night in an MLS Wild Card playoff match.

New York advanced to face Los Angeles in the semifinals. The Red Bulls host the first leg Sunday and the second leg is at the Galaxy on Nov. 3.

Frank Rost made eight saves for the shutout, despite the team playing a man down from the 79th minute on after Solli Jan Gunnar was ejected with a red card.

"I suppose you can compare this match with the match four weeks ago, it was the same," said Rost, referring to New York's 1-0 win here Sept. 17 that sparked the Red Bulls' 4-2-1 stretch run that helped them land the final spot in the postseason. "We defended well and we scored with our two chances and that's football."

Thierry Henry scored in the 96th minute to finish it off just seconds before the final whistle.

"A solid game for us, definitely the key for us was our defense," said New York coach Hans Backe, whose club has now won four consecutive road playoff matches. "Even when we were one down, they still showed unbelievable discipline in our defense. I'm excited, I'm very pleased with our defense."

Dallas lost in the MLS Cup final last season.

"I really thought that we came out very lively and with really good team chemistry and to do everything we possibly could to get the result we wanted," said Dallas coach Schellas Hyndman. "I thought we put some really good pressure on New York, but we just couldn't get on the end of some of the services, or we couldn't get the shot on frame. I thought we did everything we possibly could. No excuses, they came in and beat us on our field."

Lindpere connected in the 61st minute to put New York up 1-0. Seconds after Dallas goalkeeper Kevin Hartman made a spectacular diving save on Lindpere's blast from 25 yards out, Mehdi Ballouchy fed a pass from the right side of the penalty area into the middle, where the charging Lindpere slid feet-first to chip it past Hartman.

"I ended up cutting back and playing it to my left," said Ballouchy, who had just entered the game two minutes earlier. "Their back stepped up and opened up Joel and he was able to finish it. We were fortunate to get the first goal of the game."

It was the second career MLS playoff goal for Lindpere, who had seven goals and seven assists during the regular season.

Dallas nearly tied it in the 76th minute when leading scorer Brek Shea chased down a loose ball on the left side of the area and popped it over the sliding Rost towards the open net, but defender Tim Ream managed to clear it out.

"He knows if I go out, he stays on the line," Rost said of Ream. "It's automatic, if you play week-for-week, then you have the rhythm. We've played in this formation for the fourth or fifth time, and you can see it."

The complexion of the match then changed three minutes later when Gunnar was shown the red card for his slide tackle that took out Dallas captain Daniel Hernandez.

"I would say I can understand the referee after seeing the replay," said Backe of the call. "I think it is a 50-50. In England it would be a yellow, definitely, but I can understand why he gave him the red card."

Dallas continued to press for the equalizer, but Rost denied Jackson Goncalves' 20-yard shot in the 85th minute and then Maicon Santos's blast from 25 yards out curled just wide of the right goalpost.

The teams wound up playing 10-on-10 for the 6 minutes of stoppage time when Dallas defender Zach Loyd was injured and carried off on a stretcher, after Dallas had already used up all of its substitutions.

Henry, who finished third in the MLS with 14 regular season goals, sealed the win following a breakaway just before the final whistle.

After chasing down a New York clear, he dribbled into the penalty area, where Hartman stopped the initial shot, but the rebound rolled towards the right post and Henry got to it first, tapping it over the line.

Nokia World attendees were treated with a live demonstration of the new Xbox Dashboard, and as well as a demo of a new Windows Phone Mango app that will communicate with your Xbox.

We have seen leaked images and videos of this upcoming Dashboard update, so we already knew that it would look very much like Microsoft?s Metro UI found on Windows Phone devices. Joe Belfiore, Director of the Windows Phone program, showed how the new styling mimicked how Metro UI looks and functions. He also informed the audience that users will be able to navigate the UI by using Kinect. It is not clear how Kinect will control the UI, if it will all be voice controlled or if you will be able to swipe through the menus.

Belfiore also showed off a soon to be released Mango app called Xbox companion. With this app when you are home you will be able to control the functions of your Xbox with your phone. You will be able to launch games, videos, and even search for content using Bing on your Xbox. The feature that was most impressive to us though was that when your Xbox is playing a movie or a game your Mango device will give you information about that movie or game.

There is still no official release date for the new Dashboard, but we have heard rumors that are pointing to November 15. This would line up with the original launch date of the original Xbox, so the rumors make sense to us.

Supercommittee plans show chasm (Politico)

Democrats and Republicans exchanged competing deficit reduction plans Wednesday with the biggest partisan split less over spending per se and more the willingness to find some solution to the impasse over tax revenues.

Each party assumes hundreds of billions of dollars in savings from federal health-care programs for the elderly and poor, as well as additional cuts from appropriations, already hit under the August budget accord. But Republicans continue to balk at any major commitment to new taxes, and the result is the GOP?s $2.2 trillion package is about a third less than the Democrats? offer, which assumes $1.3 trillion in new tax revenues over the next 10 years.

The back-and-forth played out behind closed doors at the House-Senate supercommittee, which is charged with coming up with a plan that will achieve at least $1.2 trillion in deficit reduction over the coming decade.

With the Nov. 23 deadline less than a month away, both parties are under pressure to shoot higher but equally fearful of outright failure, forcing across-the-board cuts and what could be a political debacle for a Congress already held is such low regard.

As if sensing this, Democrats appear willing to put more on the table ? including landmark changes impacting Medicare and Social Security ? to try to force the GOP?s hand on taxes. Yet having begun the year boldly with ambitious deficit reduction plans, Republicans can appear paralyzed by their anti-tax political pledges ? even at the risk of losing a major deficit reduction package.

Given the secrecy surrounding the committee?s deliberations ? staff was asked to leave during some of Wednesday?s presentations ?the full details of each plan are not certain. But from interviews with both sides, here is a partial picture:

Democrats outlined a package in the range of $3 trillion, including about $575 billion from health-related programs like Medicare and Medicaid and $400 billion more in cuts from appropriations. An additional $250 billion would come out of other federal benefits such as farm subsidies or the retirement system for federal workers. Though it is still a contentious issue inside the party, the leadership has also signaled it might include adjustments in the Consumer Price Index, impacting Social Security payments, as well as annual adjustments in the tax code. But all this would be contingent on also getting the added $1.3 trillion in tax revenues.

The Republican plan shares much of the same ground but allows for only $640 billion in revenues, and when this is broken down, very little comes directly from the sort of tax increases Democrats have been demanding.

?Their offer is a joke,? said one Democratic aide. ?Democrats came to the table with an offer that had serious skin in the game for both parties. Rather than offering real solutions, Republicans are just doing more of the same posturing they do every time they walk away from efforts to constructively tackle this crisis.?

Indeed, about $440 billion appears to be generated instead by increased government fees, high patient co-pays under Medicare, for example, or increased Part B premiums charged to higher income beneficiaries ? many changes that Democrats also accept but feel do not address the larger tax issue.

On the tax side, changes in the CPI would again yield some revenue, but the greater share of the tax revenue here ? about $200 billion ? is attributed to the impact of future tax reform spurring economic growth.

First Solar surprises with solid 3Q earnings (AP)

TEMPE, Ariz. ? First Solar has surprised the market by releasing third-quarter earnings a week early, just one day after the company's stock plunged 24 percent on the sudden departure of its CEO.

The company said Wednesday that net income rose to $196.5 million, or $2.25 per share, from $176.9 million, or $2.04 per share, a year earlier. Revenue rose 26 percent.

First Solar Inc. would only say Tuesday that CEO Rob Gillette was no longer serving the company, but broadened its reasons Wednesday.

Founder and now acting CEO Mike Ahearn said the board believes the solar company "needed a leadership change to navigate through the industry turmoil."

Solar companies are threatened by overseas competition and falling prices. Several have failed.

Shares jumped 12 percent, or $5.09, to $48.36 when the market opened.

Olympus head quits; watchdog probes firm on disclosure (Reuters)

TOKYO (Reuters) ? Olympus Corp head Tsuyoshi Kikukawa resigned on Wednesday after a scandal over hefty advisory fees wiped out half of the 92-year-old firm's market value while his successor stuck with the company's line that it had done nothing wrong.

Sources told Reuters that Japan's securities watchdog was looking into past Olympus takeover deals, focusing on whether it has properly disclosed relevant information.

Olympus fired its British chief executive Michael Woodford on October 14, just two weeks after his appointment as CEO, saying he failed to understand the company's management style and Japanese culture. Kikukawa then took over Woodford's role.

Woodford, who cut his teeth at the camera and endoscope maker as a UK salesman when he joined in 1980, said he was sacked for questioning a $687 million advisory fee linked to a $2.2 billion takeover in 2008 as well as other deals he says have destroyed about $1.3 billion of shareholder value.

He has called for the resignation of Olympus's whole board while sending dossiers on odd-looking deals to Britain's Serious Fraud Office (SFO) and Japan's Securities and Exchange Surveillance Commission (SESC). He is also in touch with the U.S. Federal Bureau of Investigation (FBI).

Josh Shores, a principal at Olympus's largest non-Japanese investor Southeastern Asset Management, told Reuters the boardroom re-shuffle was "a step in the right direction".

But he demanded the swift appointment of a "fully independent, objective third party committee" to oversee a broad corporate governance and accounting investigation by an external auditor.

"...That is the next critical step. It will not be credible if the committee is appointed by the company without any input from other stakeholders -- stakeholders and the media will not trust it," he said.

Koichi Ogawa, chief portfolio manager at Daiwa SB Investments, said the company's battered share price should rebound on the resignation.

But he added: "...in reality nothing has been cleared up. There are still many investigations left to come."

Woodford told Reuters Kikukawa's resignation was "a start" but added that his replacement -- Shuichi Takayama, a 41-year company veteran -- had also failed to demand explanations about hefty fees linked to acquisitions.

"The only way you can stop the company heading for the rocks is by answering the questions," he told Reuters in London by telephone.

Takayama sniped back, telling a news conference there was no problem with fees paid by Olympus and that the company was extremely angry that Woodford revealed internal information while he was still a director.

"I was one of those who agreed to Mr Woodford's dismissal. The reason was his autocratic actions, and these included intimidation of my own staff."

Kikukawa said in a separate statement he had stepped down to restore confidence in the company under the new management and that he would continue to work as a director.

UNANSWERED QUESTIONS

The Olympus scandal has re-ignited debate over what critics say is a deep-seated weakness of Japanese management -- a lack of strong independent oversight of boards, which gives shareholders' rights short shrift.

A small Japanese monthly business magazine called Facta first raised red flags about Olympus M&A deals in August and the SESC started paying particular attention to the company around that time, said two sources, who were not authorized to discuss the matter publicly.

SESC officials declined to comment on the probe, as did an Olympus spokeswoman.

Olympus shares fell 7.6 percent on Wednesday and have lost more than half their value since Woodford was sacked.

The Briton said he was fired for questioning the payment to unidentified advisers in the $2.2 billion takeover of medical equipment maker Gyrus. At about 30 percent of the acquisition price, that set a record in M&A fees.

Unanswered questions about the Gyrus deal and other Olympus acquisitions have spurred various theories, including speculation Japan's yakuza crime syndicates, euphemistically referred to as "anti-social forces", could be involved.

Asked whether the company's financial advisers had any connection with organized crime, Takayama said: "You are asking me about anti-social forces, but I am absolutely not aware of any such thing."

Woodford has identified the advisory firms involved in the Gyrus takeover as New York-based AXES America LLC and AXAM Investment Ltd in the Cayman Islands.

A senior Japanese lawmaker on Tuesday called for probes by financial and securities watchdogs and urged Olympus to explain the fees, which risked shareholders losing confidence in Japan.

"At least the fees were outlandish. The company must explain the whole circumstances behind the incident," said Tsutomu Okubo, deputy policy chief of the Democratic Party of Japan.

While Okubo suggested parliament should look into the matter, Japanese politicians' and the local media's initial reaction to the scandal has been remarkably muted.

But in a sign of growing alarm over potential damage to Japan's credibility, another ruling party lawmaker has asked the upper house financial affairs committee to question Tokyo Stock Exchange officials and regulators on Olympus.

Takayama, 61, joined Olympus straight from an engineering high school in 1970 and has served on the company's board since 2006 after holding several senior managerial positions.

Japan Securities Finance, a stock lending brokerage, on Tuesday put Olympus on a list of shares for which caution is advised on margin trading due to a surge in such trading.

And in a heads-up to investors, the Tokyo Stock Exchange also started announcing margin trading positions on a daily basis. The exchange also said on Wednesday it would cooperate with regulators to enforce corporate governance of listed companies.

'Joe the Plumber' launching congressional bid (AP)

TOLEDO, Ohio ? Joe the Plumber is launching his bid for Congress in Ohio.

Samuel "Joe" Wurzelbacher, who became a household name after questioning Barack Obama about his economic policies during the 2008 presidential campaign, will make his announcement Tuesday night, a county Republican official told The Associated Press.

Wurzelbacher already filed the paperwork to run as a Republican in Ohio's 9th U.S. House district, and he has set up a website to raise money.

The seat is now held by Marcy Kaptur, the longest-serving Democratic woman in the House. She's expected to face a primary challenge from Rep. Dennis Kucinich after Ohio's redrawn congressional map combined their two districts into one that appears heavily tilted toward Democrats.

Wurzelbacher has become an icon for many anti-establishment conservatives and has traveled the country speaking at tea party rallies and conservative gatherings.

Republicans in northern Ohio recruited him to run and think he'll be able to bring in enough money to make a serious challenge.

"When you're relevant and have friends in high places, you have the ability to raise big sums of money," said Lucas County GOP Chairman Jon Stainbrook.

He'll appeal to people who are tired of politics as usual, Stainbrook said. "He's tapped into this sentiment that things in Washington are screwed up," Stainbrook said

Cuyahoga County Republican Chairman Rob Frost, who had announced he would seek the GOP nomination, dropped out last week, clearing the way for Wurzelbacher.

Wurzelbacher, 37, went from toiling as a plumber in suburban Toledo three years ago to media sensation in a matter of days.

After questioning candidate Obama about his economic policies, Republican U.S. Sen. John McCain repeatedly cited "Joe the plumber" in a presidential debate. Wurzelbacher campaigned with McCain and his running mate, Sarah Palin, but he criticized McCain in his book and said he did not want him as the GOP presidential nominee.

Since then, he's written a book, worked with a veterans' organization that provides outdoor programs for wounded soldiers and traveled the country speaking at tea party rallies and conservative gatherings.

He has shown a disdain for politicians ? both Democrat and Republican.

"Being a politician is as good as being a weatherman," Wurzelbacher said at a tea party rally last year in Nevada. "You don't have to be right, you don't have to do your job well, but you'll still have a job."

Iraq rounds up Baathists ahead of U.S. pullout (Reuters)

BAGHDAD (Reuters) ? Iraq has arrested at least 240 former members of Saddam Hussein's banned Baath Party and ex-military officers over what some senior officials described as a plot to seize power after U.S. troops withdraw at year's end.

While several officials characterized the round-up which began this week as the foiling of a specific plot, others said it was a precautionary measure before the U.S. withdrawal, nearly nine years after the 2003 invasion that ousted Saddam.

Government officials have long expressed concern that Baathists would try to retake power when U.S. troops depart.

"We have arrested a group belonging to the former Baath party that were planning to launch sabotage actions and revolt to topple the political process in the country after withdrawal of American forces," Lieutenant-General Hussein Kamal, Iraq's deputy interior minister for intelligence, told Reuters.

After ousting Saddam, U.S. forces dissolved the Iraqi security forces and purged state institutions of members of his Sunni-dominated Baath party, moves that contributed to a bloody Sunni insurgency. Iraq has since tried to bring some Baath party members not accused of major crimes back into public life.

Kamal said intelligence reports indicated that more than 300 suspects were part of a group which had been operating across Iraq, including the provinces of Baghdad, Najaf, Nassiriya, Wasit, Nineveh, Diyala, Kirkuk and Anbar.

"We are still following this dangerous group and we are working to neutralize this network with branches across Iraq," he added, declining to offer any details of the plot.

The crackdown could further alienate Sunnis, many of whom are deeply suspicious of Prime Minister Nuri al-Maliki's Shi'ite-led government. The Iraqiya political bloc, a secularist group that is supported by many Sunnis and has joined Maliki's coalition government, condemned the arrest campaign.

"Creating a crisis at this time is not in the interests of the nation," Deputy Prime Minister Saleh al-Mutlaq, a prominent Sunni and a leader of Iraqiya, said. "Such a thing will hinder the U.S. withdrawal from Iraq."

At a meeting on Tuesday, the bloc's leaders discussed the possibility of quitting the government but decided after meeting with a Maliki envoy to monitor the crackdown for now, an Iraqiya source who attended the meeting said.

LEGACY

More than eight years after the invasion and just two months ahead of a complete U.S. withdrawal, Iraq is grappling with the question of how to deal with the legacy of decades of Baathist rule. Many Iraqis joined the party just to advance in government positions and feel discrimination against members is unfair.

Iraq has passed legislation designed to partially reverse the U.S. decision in 2003 to purge the government of Baath Party members, but some accuse the Shi'ite-led government of stalling its implementation.

Since the round-up of ex-Baathists and former high-ranking army officers started earlier this week, at least 240 people have been arrested, including 33 in Salahuddin province, 33 in Diyala, 60 in Kirkuk, 40 in Basra, eight in Wasit, 27 in Nassiriya and 56 in Babil, senior security officials said.

Security and police officials said Maliki had issued arrest warrants for around 350 former Baath Party members.

"We have arrested 33 former members of the Baath Party after receiving intelligence they were organizing clandestine meetings recently," said one local official, Tikrit police Lieutenant Abdulla al-Douri. "It's a precautionary measure to stop any possible moves to restore Baath activities."

A source close to Maliki told Reuters that intelligence reports revealed the plot by a group of former Baath members to take power after the U.S. withdrawal.

"Who knows? Anything could happen in Iraq," the source said when asked if the ex-Baathists had the ability to seize power. "They still have this dream."

Concerns about the possibility of a coup are partly a response to the growing assertiveness of Maliki, a Shi'ite politician who heads a fragile and often fractious coalition government including Shi'ites, Sunnis and Kurds.

Maliki has sought to consolidate his power as violence drops and the United States narrows its role in Iraq. Some rivals resent or are suspicious of his growing stature.

The United States has about 40,000 troops in Iraq. President Barack Obama said last week that they will be withdrawn by December 31 according to the terms of a 2008 bilateral security pact.

Peres defends Abbas after Israeli foreign minister's attack (Reuters)

JERUSALEM (Reuters) ? Israeli President Shimon Peres came to the defense of Mahmoud Abbas on Tuesday after Israel's far-right foreign minister called the Palestinian president an obstacle to peace.

"Abbas and (Palestinian) Prime Minister (Salam) Fayyad are serious leaders that want peace and are working to prevent violence and extremism in our region," said Peres, a Nobel Peace Prize laureate.

"We must continue to negotiate peace with them in order to achieve full peace that will end this long conflict," he said in public remarks during a meeting with "Seinfeld" actor Jason Alexander, a member of "One Voice," an international movement promoting a two-state solution.

Israeli Foreign Minister Avigdor Lieberman, who heads an ultranationalist party in the governing coalition, said in a briefing to reporters on Monday that Abbas was blocking any progress toward peace.

"If there is an obstacle that could be removed it's Abu Mazen," he said, referring to Abbas and calling on him to resign.

"He threatens he will hand back the keys," Lieberman said, referring to the Western-backed Abbas's warnings in the past that he would quit unless a statehood deal could be achieved. "It's not a threat, it's a blessing."

There was no indication that Lieberman's fiery remarks reflected any change in Israeli government policy, and they elicited no response from Prime Minister Benjamin Netanyahu.

Netanyahu has called on Abbas to resume negotiations, which collapsed 13 months ago in a dispute over Israeli settlement building in the occupied West Bank, and abandon a unilateral bid for U.N. recognition of a Palestinian state.

Lieberman's remarks drew Palestinian anger and condemnation by a spokesman for U.N. Middle East envoy Robert Serry, and from European Union foreign policy chief Catherine Ashton, on the eve of a new push by international mediators for renewed talks.

Maja Kocijancic, a spokeswoman for Ashton, said on Tuesday Lieberman's remarks were "regrettably not helpful to create the environment of trust conducive to negotiations."

Palestinian negotiator Saeb Erekat told Voice of Palestine Radio, "we consider this tantamount to a call for the physical assassination of (Abbas)."

"This is criminal incitement. We called the American administration, we sat with our friends in the Russian Federation and the European Union," Erekat said.

Israeli and Palestinian negotiators were due to meet separately in Jerusalem on Wednesday with representatives of the Quartet of Middle East peace negotiators -- the United States, the European Union, the United Nations and Russia.

Expectations were low in Israel and the Palestinian Territories that the indirect talks could lead to a resumption of face-to-face negotiations between the two sides.

Increasing acidification in coastal waters could compromise the ability of oysters and other marine creatures to form and keep their shells, according to a new study led by University of Georgia researchers.

Their findings will be published in the November 2011 issue of Nature Geoscience. The researchers determined the combined effects of fertilizer runoff carried by the Mississippi River to the northern Gulf of Mexico and excess atmospheric carbon dioxide from burning fossil fuels result in an unexpected increase in the acidity of Gulf waters.

"Before, scientists only worried about low oxygen in waters along the coast," said Wei-Jun Cai, a professor of marine sciences in the UGA Franklin College of Arts and Sciences. "Our paper basically says not only do we need to worry about low oxygen, we also need to worry about acidification."

When plumes of river water rich with nutrients from fertilizer run into coastal waters, phytoplankton thrives. When these algae die, they sink to the sea floor and decompose, releasing carbon dioxide and decreasing the amount of oxygen in the water. The dissolved carbon dioxide reacts with water, forming an acid.

Ocean acidity also increases when excess carbon dioxide released by burning fossil fuels is absorbed from the air at the ocean's surface. The combination of these two sources of carbon dioxide decreases the ocean's ability to neutralize acid, increasing acidity beyond what would be expected from the sum of the individual processes.

As the water becomes more acidic, sea creatures that form carbonate shells or skeletons?from single-celled amoebae to oysters to corals?are less able to produce and maintain these structures. If the acidity of coastal waters continues to increase, Cai and his co-workers predict that by the end of the century these creatures won't be able to form shells.

"Many of our fisheries resources, especially shellfish, are concentrated in areas where rivers discharge onto the coast, like the northern Gulf and the East China Sea, and thus are at risk," said James T. Hollibaugh, UGA Distinguished Research Professor of marine sciences. "And of course there are likely ramifications for fish and animals further up the food chain that depend on these same shellfish for food."

Hollibaugh collaborated with Cai on the project, along with UGA post-doctoral researcher Xinping Hu, graduate students Wei-Jen Huang and Yongchen Wang and doctoral graduate Pingsan Zhao. Additional authors on the paper include Michael C. Murrell and John C. Lehrter of the Environmental Protection Agency Gulf Ecology Division; Steven Lohrenz of University of Massachusetts-Dartmouth; Wen-Chen Chou and Gwo-Ching Gong of the National Taiwan Ocean University; Weidong Zhai, Minhan Dai and Xianghu Guo of Xiamen University; and Kjell Gundersen of the University of Southern Mississippi.

Although their research focused on Gulf of Mexico coastal waters, they extended their findings globally by making the same measurements on the Changjaing (Yangtze) River, the largest river in Asia, where they found similar results.

To minimize future damage to the coastal ocean, Cai and his colleagues recommend that farmers better manage fertilizer use and societies limit fossil fuel use. Their future research will explore seasonal patterns of acidification and its influence on the coastal ecosystem.

Jackson doc's defense challenges key expert

>>> after four weeks of testimony, the prosecution is wrapping up its case in the man slaughter trial of dr. can rad murray . an expert is going to be back on the stand monday. kristin dahlgren has the story.

>> reporter: the prosecution made its final push with propofol expert dr. steven shaffer blaming conrad murray for michael jackson 's death.

>> in my view, michael jackson died while the infusion was running.

>> shaffer estimated mu murray gaip gave jackson 40 times more propofol than he admitted to police.

>> on friday, the defense tried to discredit the doctor.

>> you understand that everything you said in the past two days was your opinion. you do understand that, right?

>> much of what i have testified is basically standards of the practice of medicine.

>> his testimony capped the prosecution case that experts say has been laid out well. from the bodyguard who testified murray tried to hide drugs before calling 911 --

>> he reached over and grabbed a hand full of vials. then he reached over to me and said, here, put these in a bag.

>> to paramedics who said murray never told them jackson was given propofol. the jury heard from jackson himself sounding incoherent in a recording made by dr. can rad murray . but with the defense set to start, the case is far from over.

>> while it may seem that the defense has a tough road ahead of them, all they have to do is kick up sand and hopefully something sticks with some juror that creates reasonable doubt.

>> and their tactic may now be to put michael jackson on trial.

>> in court, the defense is et is to prove jackson self-administered drugs in a desperate bid for sleep. they'll call dr. paul white , the self-proclaimed father of propoe foll follow. michael jackson is set to take center stage as they try to convince the jury it was the king of pop and not his doctor to blame.

>>> joining us this morning, beth carace is a correspondent for true tv's "in session." good morning to you.

>> good morning.

>> let's talk about this dr. shaffer who said in probably the strongest testimony yesterday that dr. murray created 17 instances of poor egregious care. is that the crux of the case?

>> it really is. the one thing is setting up that infusi infusion, the i.v. drip that kept running even after michael jackson died. so, really, if you had to pick a couple of things, it would be giving propofol outside a hospital setting and then leaving his side. for two to 45 minutes is unclear how long he was left his side and things went wrong during that time and the drip kept going even after michael jackson died and that's why he had such a high level in his body. so while he committed 17 errors, some of them aggreegregious, some un unethical, those two that i've highlighted are the critical ones.

>> how many doors are open for the defense to make its case?

>> the defense is arguing that there wasn't that infusion, that drip. they're saying, no, he gave him a small injection of propoe follow. and whatever it was in there that killed michael jackson , michael jackson is responsible for himself. he had to have taken pills, injection of profo poe follow or something like that. the defense , they know is coming, but the defense has to explain the level of propofol and how he could have given it to himself.

>> so the defense is going to bring dr. paul white , the father of propofol. is the junl jury going to be left to try to decide which anesthesiologist to believe?

>> yes, that's part of it. well, that's a large part of it. it comes down to the science here of what actually did cause the death. but the state says, even if you believe the defense that michael jackson is responsible, dr. murray left his side. you do not leave the side of a patient. so even if michael jackson ingested, dr. murray is still at fault.

>> member of the family have been coming to the trial each day as the prosecution comes to a close. what has their mood been like?

>> well, the courtroom is always pretty full. a time of michael jackson families are always there. randy jackson has been there every day. sisters, we think more family members will be returning. there were several of them during the beginning of the trial since things will be wrapping up in the next few weeks. but, you know, it's a somber courtroom. but there have been some sparring matches between these two experts. the defense expert has been making faces. the judge has admonished him because he does not like what dr. shaffer is saying. he's going to be testifying this week. the judge has already set a hearing for after the trial to decide whether to hold that expert in contempt because of his conduct.
